[REPUBLIC ACT NO. 10172]
AN ACT FURTHER AUTHORIZING THE CITY OR MUNICIPAL CIVIL REGISTRAR OR THE CONSUL GENERAL TO CORRECT CLERICAL OR TYPOGRAPHICAL ERRORS IN THE DAY AND MONTH IN THE DATE OF BIRTH OR SEX OF A PERSON APPEARING IN THE CIVIL REGISTER WITHOUT NEED OF A JUDICIAL ORDER, AMENDING FOR THIS PURPOSE REPUBLIC ACT NUMBERED NINETY FORTY-EIGHT
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Section 1 of Republic Act No. 9048, hereinafter referred to as the Act, is hereby amended to read as follows:
“SECTION 1. Authority to Correct Clerical or Typographical Error and Change of First Name or Nickname. – No entry in a civil register shall be changed or corrected without a judicial order, except for clerical or typographical errors and change of first name or nickname, the day and month in the date of birth or sex of a person where it is patently clear that there was a clerical or typographical error or mistake in the entry, which can be corrected or changed by the concerned city or municipal civil registrar or consul general in accordance with the provisions of this Act and its implementing rules and regulations.”
SEC. 2. Section 2, paragraph (3) of the Act is likewise amended to read as follows:
“SEC. 2. Definition of Terms. – As used in this Act, the following terms shall mean:
(1) xxx xxx
(2) xxx xxx
(3) ‘Clerical or typographical error’ refers to a mistake committed in the performance of clerical work in writing, copying, transcribing or typing an entry in the civil register that is harmless and innocuous, such as misspelled name or misspelled place of birth, mistake in the entry of day and month in the date of birth or the sex of the person or the like, which is visible to the eyes or obvious to the understanding, and can be corrected or changed only by reference to other existing record or records: Provided, however, That no correction must involve the change of nationality, age, or status of the petitioner.”
SEC. 3. Section 5 of the Act is hereby amended to read as follows:
“SEC. 5. Form and Contents of the Petition. – The petition for correction of a clerical or typographical error, or for change of first name or nickname, as the case may be, shall be in the form of an affidavit, subscribed and sworn to before any person authorized by law to administer oaths. The affidavit shall set forth facts necessary to establish the merits of the petition and shall show affirmatively that the petitioner is competent to testify to the matters stated. The petitioner shall state the particular erroneous entry or entries, which are sought to be corrected and/or the change sought to be made.
The petition shall be supported with the following documents:
(1) A certified true machine copy of the certificate or of the page of the registry book containing the entry or entries sought to be corrected or changed;
(2) At least two (2) public or private documents showing the correct entry or entries upon which the correction or change shall be based; and
(3) Other documents which the petitioner or the city or municipal civil registrar or the consul general may consider relevant and necessary for the approval of the petition.
No petition for correction of erroneous entry concerning the date of birth or the sex of a person shall be entertained except if the petition is accompanied by earliest school record or earliest school documents such as, but not limited to, medical records, baptismal certificate and other documents issued by religious authorities; nor shall any entry involving change of gender corrected except if the petition is accompanied by a certification issued by an accredited government physician attesting to the fact that the petitioner has not undergone sex change or sex transplant. The petition for change of first name or nickname, or for correction of erroneous entry concerning the day and month in the date of birth or the sex of a person, as the case may be, shall be published at least once a week for two (2) consecutive weeks in a newspaper of general circulation.
Furthermore, the petitioner shall submit a certification from the appropriate law enforcements, agencies that he has no pending case or no criminal record.
The petition and its supporting papers shall be filed in three (3) copies to be distributed as follows: first copy to the concerned city or municipal civil registrar, or the consul general; second copy to the Office of the Civil Registrar General; and third copy to the petitioner.”
SEC. 4. Section 8 of the Act is hereby amended to read as follows:
“SEC. 8. Payment of Fees. – The city or municipal civil registrar or the consul general shall be authorized to collect reasonable fees as a condition for accepting the petition. An indigent petitioner shall be exempt from the payment of the said fee.
The fees collected by the city or municipal civil registrar or the consul general pursuant to this Act shall accrue to the funds of the Local Civil Registry Office concerned or the Office of the Consul General for modernization of the office and hiring of new personnel and procurement of supplies, subject to government accounting and auditing rules.”
SEC. 5. Separability Clause. – If any provision of this Act shall at any time be found to be unconstitutional or invalid, the remainder thereof not affected by such declaration shall remain in full force and effect.
SEC. 6. Repealing Clause. – Any laws, decrees, rules or regulations inconsistent with the provisions of this Act are hereby repealed or modified accordingly.
SEC. 7. Effectivity Clause. – This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in at least two (2) newspapers of general circulation.

Globe, nagbabala sa panibagong text scam



Pinapayuhan ng Globe Telecom ang mga postpaid subscriber nito kaugnay ng panibagong modus ng panloloko sa pamamagitan ng mga text messages.

Ayon sa Globe, may mga text message ngayon na kumakalat kung saan ibinabalitang nanalo umano ang isang subscriber ng diskwento sa kanilang buwanang bill at kailangan lang i-text ang isang numero.

Narito ang isang halimbawa ng kumakalat na text message:

GLOBE Postpaid: Congrats! You're the one selected postpaid plan given P150 discount billing, to get your P150 discount billing just text 150 send to 2916XXXXXXX.

Babala ng Globe, sa pamamagitan ng paglalagay ng number "2" sa unahan ng 10 digit cell phone, hindi alam ng subscriber na gumagawa na ito ng Share-A-Load transaction kung saan ipinapasa nito ang 150 load papunta sa naturang numero.

Sinabi pa ng Globe na dapat pagdudahan agad ang mga naturang mensahe lalo't hindi naman ito nanggaling sa opisyal na four-digit Globe number.

Makabubuti anilang huwag na lang pansinin ang mga ganitong uri ng mensahe o kaya naman'y agad iulat sa mga awtorisadong Globe customer channel katulad na lang sa Twitter (@Talk2Globe) o via SMS (text HELP send to 1234).

FLASH REPORT: Iwas muna kayo sa SM Megamall Department Store, may nagaganap na holdapan, barilan ngayon doon. Bandang 7:40 ng gabi ngayon araw na ito 26Jan, 2013. Di umano 5 kataon ang nangahas na mang holdap sa loob ng Department store, binasag ng isa sa mga holdaper ang salamin ng display para kunin ang mga alahas. Nasugatan sa pangyayari ang mismong holdaper. Nagpaputok ang mga holdaper para magkagulo at sumabay sa mga tao palabas ng Mall. Hanggang sa ngayon at tinutugis ang mga salarin. Naka-cosplay umano ang mga suspek. Sa ngayon wala pang nababalitang casualty. 

Abangan ang balita habang nagaganap ito, dito lang sa FLASH REPORT.




Nagkagulo ang mga tao sa loob ng SM Megamall matapos ang nangyaring pamamaril sa loob ng department store. 
Sa panayam ng DZMM, kinumpirma ni Mandaluyong Mayor Benhur Abalos na isang robbery ang naganap sa jewelry store na nasa ground floor ng Building B ng mall pasado alas-7:00 ng gabi ngayong Sabado. 

Sinabi pa ng alkalde na under control na ang sitwasyon at wala pang napaulat na nasaktan. Wala rin aniyang naganap na panghohostage. 

Sinabi naman ni Mandaluyong police Senior Superintendent Florendo Quibuyen na wala pang nahuhuli sa limang suspek at patuloy pa rin ang kanilang follow-up operation. 

Kinumpirma rin nitong may mga natangay na alahas ang mga suspek ngunit hindi pa mabatid ang bilang o halaga dahil wala pa silang nakakausap mula sa management ng mall.

Sa panayam naman ng DZMM sa ilang testigo na nagkataong nasa loob ng mall nang maganap ang pamamaril, nagulat na lang aniya sila ng makarinig sila ng magkasunod na putok ng baril at tunog ng nabasag na salamin. 

Hinihinalang miyembro ng tinatawag na "Martilyo Gang" ang mga nagnakaw sa mall dahil sa modus nito na pagbabasag ng salamin ng eskaparate para nakawin ang mga laman nito. 

Sinabi naman ni Eastern Police District Director Chief Superintendent Miguel Laurel na nakakuha na sila ng isang malinaw na kuha ng closed circuit television (CCTV) camera kung saan kita ang pagkakakilanlan ng isa sa mga suspek. 

Sugatan aniya ang isa sa mga suspek dahil sa mga dugo sa nabasag na salamin ng eskaparate, patunay na sumabit pa ang kamay nito habang kinukuha ang mga alahas.

Agad isinara ang lahat ng entrance sa Megamall habang isa-isa namang kinapkapan ang mga pinalalabas dahil sa posibilidad na nakihalubilo na ang mga suspek sa mga tao.

IMF tempers global outlook but upgrades that for PH




DAVOS, Switzerland—The International Monetary Fund has tempered its outlook on the global economy for 2013, which the institution sees as a “make-or-break” year likely fraught with a fragile economic recovery and high uncertainties.
But in spite of the cautious global economic outlook painted by IMF managing director Christine Lagarde during the World Economic Forum annual meetings here, the Philippines is one of the few economies that obtained an upgrade in economic outlook. The IMF now sees the Philippines growing by 6 percent this year and 5.5 percent next year, much higher than the 4.8 percent earlier forecast by the fund for both years.
On the other hand, the IMF now expects the global economy to expand by 3.5 percent this year, 0.1 percent slower than the multilateral institution’s forecast late last year but better than the 3.2 percent estimated growth for last year.
IMF’s latest growth forecast for the Philippines is seen outperforming the average growth of 5.5 percent this year and 5.7 percent next year for the Southeast Asian bloc.
Lagarde said in an address to the WEF annual meeting that due to policy actions taken over the past year, the global economy had seen some respite and stabilization in financial conditions.
“But it is not all good news. The recovery is still weak, and uncertainty is still high…. The short-term pressures might have alleviated, but the longer-term pressures are still with us,” Lagarde said. “As I have said recently, and it bears repeating: we have avoided collapse, but we need to guard against any relapse. 2013 will be a make-or-break year. We all know the imperative—keep up the momentum on the policy actions needed to put uncertainty to rest.”
Lagarde was scheduled to meet with President Aquino Thursday afternoon (close to midnight in Manila) on the sidelines of the WEF, which the Philippine President is attending for the first time. Apart from sharing the Philippine growth and good governance story, Communications Secretary Ramon Carandang said this would be an opportunity for the Philippine delegation to pick the brains of global leaders like Lagarde on global prospects.
In a separate statement by the IMF mission to the Philippines, the Fund said the Philippines’ growth resilience and more favorable outlook was both a testament to the improved macroeconomic fundamentals, policy reforms and a reflection of the exceptional global setting.
“The focus on good governance has buoyed confidence and is supportive of more-inclusive growth. In addition, growth in the Philippines has been supported by unusually accommodative monetary policies in major advanced economies that are spilling over to domestic financial conditions,” the statement said.
In a dialogue with WEF founder and chairman emeritus Klaus Schwab, the IMF chief said while the expected pace of expansion in 2013 was not huge, “it’s positive and the key thing is to keep the momentum.”
For the euro area, Lagarde said, this meant making firewalls operational; pushing ahead with banking union; continuing with the difficult but necessary fiscal adjustment at the country level; and supporting demand, especially with further monetary easing.
For the United States, she said, this meant pulling together in the national interest and avoiding further avoidable policy mistakes, such as failing to agree on increasing the debt ceiling—and, for the United States and Japan, reaching agreement on medium-term debt reduction.
For the emerging and developing economies, Lagarde said, this meant faring better despite their concerns about continued turmoil and lack of decisive action in the advanced economies, conditions differ greatly. “Some are more vulnerable than others, but they need to rebuild the policy space that has been used up in alleviating the crisis in recent times,” she said.
Taking a broader view in Davos, Lagarde urged the global economy to be conscious of the “megatrends” shaping the future.
First, she said, the global community must recognize the growing demand for individual empowerment, including for women, and a growing sense of a single global community.
Second, she noted a reallocation of political and economic power across the world. “By 2025, for example, two-thirds of the world’s population will live in Asia. This can lead to greater cooperation or to greater tension and competition,” she said.
Third, she noted a seismic shift in demographics, as the “youth bulge” in various emerging regions rubs up against the “graying” populations elsewhere. She pointed out that 60 percent of the population in the Middle East and North Africa is under 30, and for sub-Saharan Africa, 70 percent. This, she said, was “either a great opportunity or a source of instability.”
Fourth, she noted an increasing vulnerability from resource scarcity and climate change, with the potential for major social and economic disruption. “This is the real wild card in the pack,” she said.
